Email Communications & Marketing

TH-EY sends service communications needed to deliver and administer TH-EY’s services. This includes booking confirmations, calendar invites and reminders, support responses, project status updates and weekly reports under an active engagement, follow-ups related to ongoing work, invoices, and important service, security, or legal notices. The legal basis is performance of a contract or steps taken at the visitor’s or client’s request (Art. 6(1)(b) GDPR), TH-EY’s legitimate interests in operating and improving the services (Art. 6(1)(f) GDPR), and—where applicable—legal obligations (Art. 6(1)(c) GDPR).

TH-EY sends marketing emails about TH-EY services, case studies, events, or content only when the visitor has given consent (for example by ticking a box on Calendly or other forms). The legal basis is consent (Art. 6(1)(a) GDPR). Consent can be withdrawn at any time via the “unsubscribe” link in any marketing email or by emailing hello@th-ey.com. Withdrawal does not affect processing carried out before withdrawal.

For marketing emails, TH-EY processes the visitor’s name, email address, company details (if provided), the fact and time consent was given and how it was obtained (e.g. Calendly form), and limited engagement data (such as opens and link clicks) to understand what is helpful and to improve communications. Emails are delivered through trusted third-party providers acting as processors. Processing may occur in the EU/EEA or in countries ensuring adequate protection. Where data is transferred outside the EU/EEA or UK, TH-EY relies on lawful transfer mechanisms (such as Standard Contractual Clauses) and appropriate safeguards.

Retention for marketing audience data: TH-EY keeps contact details used to send marketing emails until the visitor unsubscribes or for 24 months after the last engagement with a marketing email (e.g. open, click, or reply), whichever comes first. After that, TH-EY removes the contact from marketing systems and deletes or anonymizes the marketing data within 30 days.

Retention for consent evidence (separate from marketing data): To meet GDPR accountability and to demonstrate consent (Arts. 5(2) and 7(1) GDPR), TH-EY keeps a minimal, separate record for up to 6 years. This record includes only what is necessary—such as the email identifier (minimized where feasible, e.g. hashed), time and source of consent (form name, checkbox text/version), IP or user agent, and the unsubscribe event if applicable. This record has restricted access and is not used for marketing.

Visitors and clients can unsubscribe from marketing at any time and may exercise the rights listed in the “GDPR Data Protection Rights” section, including the right to object to direct marketing. If erasure is requested, TH-EY deletes marketing audience data and keeps only the minimal consent record to the extent necessary to comply with legal obligations or to establish or defend legal claims (Art. 17(3) GDPR). TH-EY does not sell personal data or share it with third parties for their own marketing without consent.
